Vulnerable Worker Open Work Permit

If you hold an employer-specific work permit and you are experiencing abuse — or you are at risk of it — you do not have to choose between your safety and your status in Canada. This permit exists so you can leave, and it does not require your employer's knowledge, consent or cooperation.

What counts as abuse

IRCC defines it broadly, as any behaviour that scares, controls or isolates you. It does not have to be physical.

  • Physical or sexual abuse, threats, or intimidation.
  • Financial abuse — wage theft, unpaid overtime, illegal deductions, recruitment fees, or withholding pay.
  • Psychological abuse — humiliation, isolation, or threats to report you to immigration.
  • Unsafe working conditions, or unsafe employer-provided housing.
  • Restricting your movement, holding your passport or documents, or preventing contact with others.
  • Pressure to participate in fraud, or retaliation for asking questions or making a report.

Who can apply

  • You must be physically in Canada — this cannot be applied for at a port of entry or from abroad.
  • You must hold a valid employer-specific work permit naming the employer, or have applied to extend it before it expired and be waiting on a decision.
  • You must be experiencing abuse, or at risk of abuse, connected to that employment.
  • There is no fee. Not for the permit, and not for biometrics.

What happens to your employer

The application is about your status, not about punishing anyone, and you do not need to prove a case to a standard a court would recognise. IRCC does share information with the compliance regime, and employer inspections have increased sharply — penalties across the Temporary Foreign Worker Program more than doubled year over year, with employers receiving bans of two, five and ten years. But your permit does not depend on that outcome.

You do not need your employer's permission, signature or knowledge to apply. If someone has told you that you cannot leave a job without their consent, that is not the law.

Getting it right

These applications are decided on the evidence you can put together, often quickly and under pressure. Text messages, pay records, photographs of accommodation, a contemporaneous written account — these matter, and they are easier to gather before you leave than after. If you are in an unsafe situation right now, contact a licensed RCIC or a settlement agency immediately; there are also emergency routes and support services that sit alongside this permit.

Frequently asked questions

Does my employer find out I applied?

You do not need their consent, signature or knowledge to apply, and the application does not go through them. IRCC may separately inspect an employer under the compliance regime, but your permit does not depend on the outcome and is not conditional on you making a formal complaint.

How much does it cost?

Nothing. IRCC charges no fee for this work permit, and biometrics are also free for this application. Anyone telling you there is a government fee for a vulnerable worker permit is mistaken.

Do I have to prove the abuse in court?

No. There is no court process and no criminal standard of proof. IRCC assesses whether you are experiencing, or at risk of, abuse based on the evidence you provide. Contemporaneous evidence — messages, pay records, photos, a written account with dates — carries real weight.

What if my work permit has already expired?

You may still qualify if you applied to extend before it expired and are waiting on a decision. If your status has lapsed entirely, restoration may be possible within 90 days. Either way, get advice immediately — the options narrow fast.

Can my family stay in Canada?

Family members' status usually depends on yours, so it needs looking at as part of the same plan. Do not assume it is automatic and do not assume it is impossible — this is exactly the kind of thing worth a conversation with a licensed consultant.
